Personal Injury Cases

We deal with Road traffic accidents {any accident arising from use of the public roadway as a pedestrian ,cyclist , motor cyclist ,car passenger  or bus passenger }and the personal injury arising from them.   If you have been injured in a road traffic accident you may be entitled to make an accident or personal injury compensation claim, for the injuries and losses which you have suffered as a result of the  road traffic accident. To succeed you must prove that the accident was caused by someone else who breached the duty of care {which is negligence}  .The type of injuries suffered are usually whip lash,  back injuries ,head injuries and injuries to the spine  .If negligence is proved the injured person can claim for  damages arising from the  accident and also for special damages arising from the accident .The claim can be under the headings of loss of earnings , compensation of pain and suffering  and  money lost on specific medical costs relating to the accident .If you have an accident and suffer personal injury arising from a hit and run or from an accident where the  vehicle was uninsured the Motor  Bureau of Ireland  deals with  such   situations and they  compensate victims of road traffic accidents caused by  unidentified   vehicles  or vehicles which were uninsured  .  

The action is taken against the driver of the vehicle who caused the  road traffic accident The cases are usually taken in the  Circuit Court or in the High Court The  personal injury claim for compensation would be dealt with by the Insurance Company for the driver at fault   about your case.   Personal injury claims take up to two years . We do not  settle cases  before   injuries have settled  and we are furnished with a medical prognosis as to the future effects of any injury.  A specialist advises us in a medical report on your   your medical condition  adn the Barrister uses these reports to decide the value of your compensation claim

Before commencing Court proceedings in Ireland, all personal injury claims  must be submitted first to the Injuries Board ( PIAB). The Injuries Board  assess  the amount of compensation due to a person who has suffered a personal injury. The Injuries board do not  involve themselves  if liability is at issue   If both sides agree   an assessment of damages can be carried out by the Injuries Board  We   represent clients in their dealings with the Injuries Board. It is important to receive legal advice to ensure that the compensation settlement claim awarded by the Injuries Board does not fall short of what it should be   . If a Defendant refuses to have a matter dealt with by the Injuries Board or if an award is made by them which  is rejected    then the compensation claim can proceed to Court . Court  proceedings in Circuit and High Court  issue against the person  or entity who caused the personal injury . We ensure that we obtain reports from consultant specialists and  engineers .Your case will be  sent to a Barrister who will draft papers claiming personal injury and  making a claim for compensation . The solicitor  will then liaise with the barrister who  drafts all the  legal papers required to process the personal injury claim Often an offer of financial settlement is made before the case goes to hearing    You will have to decide to accept or reject the offer of compensation  which is made at this time  ,If the offer of compensation   is accepted then the case is settled and at an end  If the settlement offer is rejected then the case progresses into its final stages in Court .  

You will be given the date of your court case and you must ensure that you are available to attend in Court .You will  be required to  go into the witness box and give evidence  and will be asked questions about your recollection of the events of the  accident Both sides will call  witnesses to support their cases. Based on the legal arguments from both sides, a   judge will make a decision on the case. If you win, you should receive a sum of money plus your costs .
